Indonesian Constitutional Court puts bloggers on the same level as journos

Can this be true? The Constitutional Court ruling that the role of bloggers is as important as the Press’s?

Unspun is all for blogging and think that the kind of journalism many papers, on the cost cutting trail, put out is not necessarily better but this may be a case of taking citizen journalism a bit beyond what’s reasonable.

Blogs rarely break news. They can be aggregators of what others are reporting, put a veneer of opinion and interpretation of what’s happening, but often bloggers are not putting their necks out like journalists do.

Bloggers should enjoy freedom of expression but do they deserve to be held as high (or low, depending on your perspective) as professional journalists?

Blog dan Bloger memiliki peran yang sama dengan pers, yaitu sebagai salah satu wujud kedaulatan rakyat yang berasaskan prinsip demokrasi, keadilan dan supremasi hukum.


Begitulah salah satu catatan penting Mahkamah Konstitusi dalam putusan atas gugatan Edy Cahyono, Nenda Inasa Fadhilah, Amrie Hakim, PBHI, AJI, dan LBH Pers atas pasal 27 ayat 3 Undang-Undang nomor 11 tahun 2008 tentang Informasi dan Transaksi Elektronik. Permohonan pengujian pasal tersebut didasarkan pada kekhawatiran bahwa ayat tersebut dapat mengekang kebebasan berekspresi dan berpendapat, khususnya di Internet.

Kabar itu saya dapat dari siaran pers yang dikeluarkan pada 5 Mei 2009 oleh Tim Advokasi untuk Kemerdekaan Berekspresi di Indonesia. Siaran pers berisi pernyataan sikap Tim yang kecewa atas putusan Mahkamah Konstitusi yang menolak gugatan para pemohon.
